I don't understand the divorce process, advice!

Hi, my head is fried, i have loads going on! I've applied for the divorce, had one mediation session back in november, waited 6 months for his pension summery but last month I found out via mediation that he didn't actually apply for his pension summary so I've waited 6 months for nothing and I don't even know if he has even applied for the pension.

Anyway, I have spoke to a friend who has been though it all and she has confused me, she said I need to go ahead and apply for the conditonal order ( this was due on the 2/11/24) I was told that I needed to wait to proceed with this until finances have agreed. Now I'm wondering if I should go ahead and continue the conditional order. We are a long way away from from getting any sort of finances sorted as he is being difficult no pension details and no further mediation booked in untill the pension come back.

We are going through divorce and I would say do a voluntary form E which is financial disclosure. Agree a date on which these should be exchanged do not exchange yours until he is ready. It is important to get the financial order agreed before moving forward as although you would be divorced you will still be financially tied.
I would suggest asking for your mediator or solicitor to arrange this. Once you have agreed then go for the conditional order on the divorce. That way you are financially secured before your divorce comes through. Solicitors offer a one off meeting where you can get advice this is usually around £150 but maybe more.

it says on gov.uk that you can do the financials after if that is better. I did this. I was just desperate to get divorced. Applied for the quick divorce online and then did the financials, but this may not work for you. Just saying it is possible.

Mediation said its better not not continue untill we have agreed finances.
It getting to the point that I will have to go to a solicitor and court to force him to prove he has actually applied for the pension summery. He plays so many games and tells so many lies.

We have 51k to split between us and thats it, no other joint assets. The man is a joke

For the sake of £51k I'd do as pp suggested and push ahead with the divorce and sort the financials later.

The longer you leave it, the more money will accumulate in his pension, silly sod.

How old is he?

Normally yes, but £51k isn't worth quibbling over anyway really, by the time you take fees out of it and divide it in half.

@planroundstops it’s hard to remember. I put the paperwork in the moment online divorce was allowed and I think it was maybe 8 weeks later I got my decree absolute. Around that time.

@MaggieBsBoat did you not have to complete the 20 week wait and 6 week wait? Was in the new no fault divorce ?

It takes 6 weeks after requesting the conditional order for it to be confirmed so you might as well carry on. Then I think you have to apply for the final order - it’s all very slow
