Hi

Please can anyone advise - can you apply for financial order by filling form A without engaging with ex and without attending mediation or getting MIAM certificate.

Will the court reject application if mediation not even attempted?

You have to mediate or be exempt from mediation under one of the exemption categories.

If not it will be rejected.

You would still need a mediator to sign off that mediation is not suitable if you don't meet the criteria for an exemption. Some mediators may offer an attempt online. Others might be happy to sign off as unsuitable but you would need to engage a mediator and have that conversation with them.

To submit the Form A you need either proof of exemption, or a completed section 4 signed by a mediator which says wither mediation took place or its not suitable.
