Hi. Anyone in this group or know of anyone personally that has been successful in making a claim against ex where finances were not settled with clean break at time of divorce? Did judge grant it? Circs are it was a 2 year marriage, no kids, no joint assets as lived in my parents home. We only lived together for 2 months during marriage and no cohabiting before. Separated after 6 months of marriage. I did not get financial order at time of divorce as ex would not engage with severing financial ties so could not get consent order. Matters not taken to court as financially couldn’t afford to. Has ex got a leg to stand on? Not that I have any savings or anything of value - not in my name anyway. Ex is working and fully independent financially as am I

It’s pretty much the same advice given earlier in the week to the person who had their post deleted.

The marriage is short. The couple did not live together for any appreciable length of time. The clear break order will undoubtedly return the couple to their pre marriage status. Allowing each to retain the assets they had before they married and brought to the marriage. Since there is no property involved it would mean there are zero assets to share.

There is a potential legal claim but it is of very low value if even successful and wouldn’t justify the legal costs required to fight it

I mean you lived together for 2 months and then separated. You might as well have applied for an annulment.

The ex said they had it annulled but turned out they were telling porkies so I applied for divorce finalized the divorce as ex was intentionally not signing papers even though stated via email they had them and were not lifting a finger to sign them and if I wanted the divorce I had to get my dick out my hand and do whatever I need to do to get the divorce

How can I get clean break now I know ex won’t co operate and has already said they won’t respond to any of my emails nor my solicitors or even if the courts contact them they’ll ignore it all as ex lives in Canada so thinks they’re untouchable
