Hi,

This separation/divorce is not treating me well - but I have a question.

I am in Scotland so debts, no matter who's name they are in, if they were acquired during the marriage, they are split 50/50.

My question is how does this work?

For example, If I have debts in my name for 20,000
husband has debts of 10,000
Total debt would be £30,000 and we would be responsible for £15,000 each.

Would he give me money out of the house equity to give me the £5,000 to pay towards the additional debts in my name? Surely I wouldn't need to rely on a payment plan or something?

Has anyone been through this in Scotland and knows?
