Husband refusing to pay

I'm buying my husband out of our home, however I need to find a new mortage lender, because my husband said he refuses to stay on the mortgage until our current lender is happy I can afford the mortage alone, which would be around 3/6months of me paying. (I’m self employed and the accounts that the mortage provider have looked at are the ones when I was on maternity so they aren’t happy with affordability) Which is fair enough but he is now refusing to pay half of the early repayment fee. Surly this should be split between us as it’s both our responsibility. And I wouldn’t have to leave early if he would just stay on for a bit longer. Side note he isn’t buying another property for a while as he is going to be living with his mother. He also knows I won’t miss a payment, he is doing out of spite.

have you had legal advice in terms of an overall financial settlement and what % share each of you will get? I wouldn’t be doing anything re the house/mortgage until then

He can't just come off the mortgage. But he can refuse to make payments towards it.
