Can I move schools?

Can I get advice please?

I am divorced. I am looking to buy a property about 40 minutes away from my ex husband and this will require the children to move schools.

Can my ex stop this from happening?

He has made a comment today about our 3rd child (we have 4) living with him full-time as she does not want to change schools.

Any advice gratefully received. Thank you.

Yes, as he has PR any change of school has to be agreed. If not you could apply to court (first attend mediation) for a specific issues order. A judge would make a decision, following a CAFCAS report.

It will depend on a number of factors, such as impact on education or ability for child to have relationship with other parent. If the children are over 11 and do not want to move the judge will listen to their "wishes and feelings"

As PP said: your ex h has Parental Responsibility so you would both need to agree. If the children are settled at school then why are you moving them? If you make an app to court they will look at what is in the best interests of the children so you would need to show why.

He could, yes. If he’s not in agreement, he can take it to court to stop you.
