I’ve NC as not ready to go public. Husband wants to separate- this has been coming for a long time. I am a SAHM with school age children. Husband works PAYE. He is happy to move out. He has property that pre dates the marriage in his name alone and currently rented out and pays tax on the income. I was calculating my entitlement to UC, however I’m not sure if I’m eligible as asking about any other assets and I don’t know if I have to declare my husbands as they will come under marital assets in the divorce. Can anyone help? If I can not claim the UC I will be in a terrible situation.

If you claim UC you'll be expected to start looking for work ASAP. You should be able to claim if you have no access to money whilst the divorce is ongoing after you've separated - but expect they'll want you to find a job.

Don't think hubby's rental properties will be partly your assets if he purchased them prior to marriage and they are in his or a company name

They do predate the marriage. His name only

His rental house that you have no finances from will not count for UC assets. It does count as a marital asset for divorce financial settlement. Good luck. It's scary when it's all new x
