Currently going through a divorce and we are just waiting for the judge to confirm whether they agree or not and then it's the final order. Do I need to do anything the change my surname or is this don't automatically.

I want my maiden name back asap.

Do I need to apply for anything? Will this cost anything?

You can change it now. You don’t have to wait until you are divorced .

Its the name on your birth certificate.

Just start using it.

For official things you might have to show them your BC .

It won’t change automatically!

Can I do this by deed poll? Or should I just wait to see if the judge will include it

The judge won’t change your name for you. Why would they?

If you divorce or end your civil partnership
You may be able to go back to your original name by showing record-holders either your:

  • marriage certificate and decree absolute
  • civil partnership certificate and final order
Some organisations will not change your name back without a deed poll.

Change your name by deed poll

A deed poll recognises a change of name of an adult or child - make your own, use official forms, or get one through a specialist agency or solicitor

Some places might ask for your divorce certificate to change the name back though they shouldn't. You definitely don't need a deed poll. You have a birth certificate, you can use that to change it back on official documents, bank account etc.

I changed mine by Deed Poll prior to Absolute as it took so long (covid). Really easy process. Or you wait until you have the Absolute and use that. Either way, you have to do it yourself, it's not automatic.
