My soon to be ex husband and I have separate bank accounts (he doesn’t know I’m planning to leave him yet) He is the higher earner (£45K) and I’m currently in a low paid (12K) part time position, I’m actually currently on a long stretch of unpaid parental leave to look after our children.

What are the legalities as all the money goes into DHs account and I get child benefit and he sends me money for bills etc?

All assets are family assets including separate bank accounts.
It's all one pot.
Starting point is usually 50/50 then negotiated.
Just because you're not actually "earning" the money it's still family money, you're contribution is looking after the dc allowing your H to work.
Can you get sight of his account, get a copy of a bank statement?
Personally I'd look into getting a free half an hour with a solicitor.
