Hi all,
Looking for some help please. I would like to add I am going through a very tough time at the moment and kindness is appreciated, thank you in advance.
Myself and my husband are joint mortgage/property owners of our house. Unfortunately 3 weeks ago I'm a drunken rage he threw myself and our 3 year old son out of the house. At the time my son was not their thankfully and I got up and left rather willingly due to being a little scared. Now 3 weeks down the line and still no discussion from his part on where we are going to live going forward. Luckily I have a brilliant support network and we are living with my parents. My point being however that we cannot live here permanently and nor should we. I know I have a right for me and my son to live in the property until divorce proceedings and house sale is completed, but I just can't stand the thought of having to live under the same roof as him. Is this something i have no say in as we are both joint owners?

You have equal rights to live there.

The only way you can avoid this is if he agrees to move out voluntarily or if you are successful in being awarded an occupation order via the courts.
