Hi all,

I don’t know if anyone would be able to advise but here goes …

I made an application to the CMS once my STBXH left the FMH, in late July. Divorce proceedings started about 6 months prior to this. He only sees the DC every three weeks, no overnight stays. He doesn’t pay towards anything and hasn’t since our house was sold in July. I’ve just heard back from the CMS and his payments don’t start until the 2nd of October. The effective payment is from the 19th of August. This means that I miss out on 4 weeks of payments, from when the claim was first started. Is there anything I can do or do I just have to accept I won’t get it from the date the claim was made? I’ve contacted CMS and they’ve said it’s from the effective date. I can’t ask STBXH for the money as we’re not on speaking terms.

Unfortunately you can’t do much.

Former Marital Home. Thanks for your replies. It’s a shame, I thought it was from the date the claim was made. I think it’s unfair but I suppose I’ll just have to accept it.
