Interim payments advice

Hi,
My husband suddenly left. Joint mortgage and bills all in his name. He's taken his name off the bills so now it's just me. Does he "only" have to pay half the mortgage and child maintenance in the interim? I mean...I know it might sound fair but he earns 3 X what I do and I was financially dependent. My salary and his half of the mortgage and child maintenance won't cover all costs like bills, mortgage and food etc.

He cannot be made to pay anything apart from child support as part of any claim you have submitted. The onus will be on you to submit the claim if you want to ensure you have this income.

You then have two options, apply to the courts for interim spousal support until your divorce finances are finalised. He may agree to this without court as part of mediation. Whether this would be successful is anyone’s guess.

Alternatively you could apply for benefits to augment your income.

What are the actual differences in salary and can you improve your income ?

He doesn't have to pay his half of the mortgage since he isn't living there and deriving a benefit from it. His name might be on the mortgage with the bank but they can force him to pay and you are just as liable if your name is on there.

Maintenance is due at the minimum CMS calculation- he doesn't have to pay both mortgage and CMS

pp means they won’t force him to pay
you hold as joint and several so you’d simply be expected to pay if he didn’t

as per lemon- are you eligible for any top up benefits?
if income disparity is large you might be able to get interim support

where is he living now ?
