Form E and spouse not working

We are about to exchange form E and EXH is not working anymore. I am the higher earner. EXH is also being tricky and doing the paperwork at the very last minute. He didn't want to do this, he wanted it all sorted out between us informally! This is my life, I have 2 dependants, so how anyone can suggest this informally is beyond me... I think it is a) because of laziness, b) to hide how much debt he is in and c) to make things work for him.

He has credit card debt and I believe, no savings. I have some savings and no debt (except for mortgage).

We still need to agree on childcare custody however I am reading posts that if spouse does not work, they can get higher equity to house themselves. I also made a few overpayments on the mortgage.

Has anyone been in a similar situation and was this the case for you?

He will be entitled to a share of the house and any savings accrued when you were together and any pensions. Debt should be pooled if it relates to the time you were married and was accrued for a common and shared purpose.

If he cannot work due to ill health or age then his lack of income could result in a bigger share. More probably if he is fit then it will be assumed he can work and that he can have an income if he wants.
