Child maintenance question

If we arrange the child maintenance between us (don’t go through CMS) then how does it work?

Do you just put into the financial consent order that A will pay B £600 a month until both kids reach the age of 18?

How do you take into account that £600 today won’t be worth the same as £600 in 10 years time?

Do you say percentage of income?
Write in there will be an annual review?

Or is it just better to do it through the CMS and have then review it annually?

It should be a percentage of his wage depending on how many dc you have. CMS rules apply a year after the consent order.

He earns over the 156K cap so what happens then for working it out?

CMS calculator shows 2 kids with him having 1 or 2 nights a week as £1450.00 if he earns £156k. You say he earns more.

CMS don’t deal with over £156k - you’d have to go to court

I’d get good legal advice over what the court would likely order and negotiate from there if you don’t want to go down the route of an official order

Hey, for over £156k, google James vs Seymour maintenance calculator. You should get a spreadsheet where you can input variables for a top up order (earning over £156k). This is technically only a starting point but my non specialist understanding is that courts use this now (it became a thing last year).
