I'm supporting a friend who has applied for an occupation order against her abusive STBXH. She already got an ex parte non-molestation order granted a couple of weeks ago. The hearing for the occupation order is happening soon - she doesn't qualify for legal aid as she has too much equity in her house, so she is doing it without a solicitor. She's looked into various of the charities that support , and has been put in touch with an IDVA, but so far none of that is massively helping.
We've found out a lot about the process just by reading up online, but still have some questions. Has anyone been through this and can help?
If her STBXH turns up and doesn't contest the order, and the judge agrees to make it, how long is he likely to get to move out of the house? He is unlikely to be able to move in with friends or family, so would probably need to find a private rental.
If STBXH doesn't turn up, can the judge potentially make the order even without the husband there? From googling I think yes but not sure.
Any other experiences with this process welcome too, and very sorry if you've also been through this. 💐
