My decree absolute and financial consent order have been on hold until my husband has a date to move out of the marital home.
He has in the meantime been arrested and remanded in custody, likely to be sentenced and imprisoned.
I would like to know where I stand regarding finances.
My name is on the mortgage and I have always paid the mortgage and bills.
We have been married for over 14 years, and while he was willing to accept a payout not equivalent to 50% of the value of the property, i.e. below, I understand that the judge might deem the settlement unfair.
i would like to know where I stand.

You really need to speak to your solicitor on this one, it's such a bespoke situation.

If he's remanded, is the house sat empty? Can you move back in or are you in there already?

Seems to me you could argue he's moved out the family home....

Hi - I am living in the house, and until the arrest, which was last week (and I don’t know where he is) so was he.
We were waiting for confirmation of a date he could move into another property.
Once I had a date, I could then proceed with the clean break order.
I haven’t spoken with my solicitor yet as I don’t have any information on my husband’s whereabouts.

Are the charges related to domestic abuse or something else?

You / your solicitor can apply to find oru where he is: https://www.gov.uk/find-prisoner but if it's DA related and you're the victim I would not be making that application yourself. You solicitor can then write to him etc.

Many thanks. I have already contacted them for information, and waiting for a response. No, it’s not DA.
I am also monitoring the CourtServe site for any information that he might be up in court.

Which police station was he taken to? I can probably work out which prison he's gone to as there are set locations for local receptions.

If he's been charged at Magistrates recently then depending on the case hell go to Crown Court next. Initial hearing delays are bad at the moment, so he may only appear by video link from prison anyway.

I'm assuming you're not on speaking terms right now!

Thank you again.
I have a fair idea of where he’s likely to be and am just waiting for confirmation.
He rang me the day he was arrested however I’ve not had any further communication from him.
