Divorce Settlement

Hi,

I am seeking advice in regards to divorce settlements. I am not quite sure what I can ask for under the settlement. What are the general rules?

As a bit of background, my estranged husband lives abroad (he is not habitually resident in the UK). I have sole custody of the children and he hasn't been paying adequate child maintenance for the last 25 months.

I need ongoing financial support for the children. He has a property - the family home (which is currently tenanted). My name is not on the property; he bought it with his previous wife. The children and I lived in the family home for 6 years and I have registered my matrimonial home rights on the property.

He earns a significant amount of money (over 3 times my salary) and it's tax free, because where he lives he does not pay any form of tax. He also has lots of savings, where as I don't have any; I only have debts.

Any advice/guidance would be appreciated.

Is he in a REMO country? Is he registered as non dom?

Your situation sounds complicated, generally speaking all your assets and debts as a couple will be split 50/50.That is what I was told unless you or your ex has committed some horrible crime and been convicted.
Maintenance and time scale is an issue but as your ex lives abroad I really think you need some legal advise.
