Conditional Order question

Rebecca1308 · 24/01/2024 08:38

Hey, So on the 12th of Jan i applied for the conditional order after the 20 weeks of waiting. I have not yet recieved an email stating when it will be announced in court {email said by 6th March, which seems a long time}, but my question is. The 6 weeks to apply for the final order, is that counted from the day the courts grant the conditional order or from the day you made your application for a conditional order?

I've read a few threads on here and some appear to be from application date not granted and i just want to know what i can expect, i need this done with now . Also is has anyone else applied around that date and had their court date given yet?

This was a horribly abusive relationship and i just want to get it all in the past and move on with my life with my children. thanks in advance for anyone that can give me some insight x

Sorry to hear you’re going through this. The official guidance is not clear on this at all.

It is six weeks from the day your conditional order is granted.

On the bright side, what happened for me (and a few other people I spoke to on here) recently is that I heard back about the date much sooner than the deadline they had given. (The email said 8 weeks but I heard back in 4) So, you will hopefully get your date sooner than 6th March 🤞🏻

I’m now in the six week waiting period to apply for final order and several people have told me that it comes in 24-48 hours.

I found this stage so stressful - an unwelcome extra wait when you’ve already been counting the days for 20 weeks. But you will be there really soon.

Have you sorted out a financial order to sever all financial ties to your ex?

mantou2 · 24/01/2024 12:49

Same issue here. Applied for conditional Jan 1st, still heard nothing back yet. There seem to be any people posting about this issue. Called the court helpline yesterday and they said waiting times are currently 6 - 8 weeks to hear back, you then usually hear back with a court date which is a further 2 weeks after that. She did say 'you could call back next week and we could tell you the wait times have changed and may then be 5-6 weeks - all depends on volume' (?) I was also in an extremely abusive relationship which is why I am so upset this middle part of the process takes so long and why I want ties cut ASAP as I am genuinely scared of my ex. And it isn't explained properly to people before they start. It is senseless to force people to remain legally tied for so long with all these waiting periods especially where abuse is involved.

I am hoping mine will be four weeks like others who recently posted and not 8 - i will update you once I hear so you have some peace of mind about how long you're likely to wait.

mobogogi · 24/01/2024 13:02

Once the conditional is granted, you wait 6 weeks and a day then apply for the final order, it came through within 48 hours

Rebecca1308 · 24/01/2024 14:07

@mantou2 its awful isnt it. When we just want to get on with our lives. this is a huge road block for me mentally. Feels like i'm not free of it until i get that final order. Your nearly 2 weeks ahead of me then, oh goodness. I hope you get yours through very soon 🤗
@FantaLima yes financial order has been agreed thankfully but cant submit this yet i believe untiml the conditional order has been granted. I was fearing it being not until March i get a date, then another 3/4 weeks for the court then another 6 weeks for final order. Takes so long :(

Thank you for clearing this up and its such a long wait, just hope it comes through soon xx

It was about 5 weeks for me.

Mine was read out in court today and got the email confirming 2 hours later which was great.

cadburyegg · 24/01/2024 20:42

I applied for the conditional order on 25 August last year and it was read out at a granted on 11 October. I was able to apply for the final order from 23 November , but I only did it yesterday, for various reasons, and it came through within a few hours.

mantou2 · 26/01/2024 15:40

Just to give everyone some reassurance - finally heard back today (just under 4 weeks after initial application, even though they said it could take up to 8) - conditional order will be read out in 2.5 weeks :) So not that long of waiting at all!

Creativity123 · 27/01/2024 19:47

Did you give them your reference number when you called them?

Rebecca1308 · 29/01/2024 09:00

@mantou2 oh congratulations!!

thank you all for your reassurance, i hope to get my email with court date in next couple of weeks :D x

Hello all

I received my email this morning to say it will be ready out in court on 29th February so I can apply for the final order on 12th April.

DevonCream · 05/03/2024 13:42

I applied today for conditional order after a never ending 20 week wait. I've been told we will hear the date of the hearing by 8 weeks. Feels like forever. Could realistically be 10 weeks till the hearing. And then another 6 before final order!! Four whole months!!

Tony1989 · 29/03/2024 15:06

@DevonCream keep me in the loop because I'm just as frustrated waiting to hear a court date for hearing. I applied in the 27th and if I don't have the CO in the next 5 weeks then my next wedding wont be going ahead as the wedding date is 12th June and we will have to allow for the 6w1d for FO

I heard yesterday! Court date 10th April. Then 6 weeks and a day after that we will pretty much be done. That's right, isn't it?. Can't wait. But also sad. Weird isn't it.

Tony1989 · 29/03/2024 15:48

@DevonCream thank you for the update. I wonder if I will have a court date within the 4 weeks like yourself then. I am very hopeful that way won't have to move the wedding date. You are correct 6 weeks and 1 day after the CO is pronounced in court you can apply for FO. From what I have heard that's issued in 24-48 hours. If my time line is similar to yours I will be divorced one week before my wedding date. This is anxiety ridden for a while different reason for me. I really was not expecting this middle wait. 26 weeks is very very misleading. Your end is in sight though!! What part of the country do you live in? I wonder if courts are heard in different locations have different time frames. I'm East Midlands

Good luck! Am in Devon (hence the name 😂). Fingers crossed yours goes smoothly. We just need to sort finances now. Feels way more complicated than the actual divorce. Just accepted house offer and now just need to find myself somewhere to buy.

Tony1989 · 29/03/2024 20:12

Now you have mentioned the name (devoncream) I feel a little bit dull 😂. I'll post when I have mine

RareBiscuit · 03/04/2024 18:08

Seems like the are back logs with the courts. I applied for my Conditional order on the 27th March. I haven't heard anything about a court date yet. As you can see look like they are taking 3-4weeks to review applications for CO and then court dates set about 2 weeks after application is approved.

Please let me know when u heard from court, so I can expect my conditional order date. I’m so frustrated 😐

Surprisingly I heard back today. I applied for my Conditional order on the 27th March. Will be ready out in the 24th April in court. So really alot quicker than originally thought

VenetiaHallisWellPosh · 09/04/2024 10:44

That 20 week wait is a PITA. I'm not in any danger currently but I can see why this is not good for spouses in an abusive relationship. I don't know why the law was set at this amount of time.

My hearing is on Thursday and I feel a bit weird about it but hopefully in the end will see it as progress. Lots of love to everyone on this thread going through similar.
