Conditional order timescales

So I was feeling quite positive this morning the 20 weeks were up and I could apply for the conditional order. However, I then got an email saying that we wouldn't get a court date until mid March! Does anyone know if it really takes this long? And if it does, is it like mid March to get a date which could then be X weeks away? And then you have another 6 weeks after that til final order! It just feels never ending. I honestly and rather naively had no idea it took so long :-(

I had a very similar experience recently. In my case it turned out to be 7 weeks from application to court date.

I had Christmas in the middle of that wait so hopefully yours might be quicker, it does seem to vary.

I made a thread about it where several people shared their timescales which you might find useful.

Good luck - you will get there in the end!

Very long wait for conditional order - anyone else? | Mumsnet

Hi all, I’m wondering if anyone else is in a similar position or able to give some advice. My STBX applied online for our conditional order last wee...

Thank you so much for your reply, and the link to your previous discussion - really useful. It's just all so frustrating - and the 26 weeks is clearly far from true!

Yes exactly! Totally agree and I wish I had known that from the start.

HazelWicker · 20/01/2024 19:08

For what it's worth, I applied for my final order on 17th Jan. And it was granted on...17th Jan! My conditional took about six weeks I think.

HazelWicker · 20/01/2024 19:10

35 weeks mine was from application submitted to final order granted. Faster than I expected. I was hoping to be divorced within 52 weeks.

mantou2 · 20/01/2024 23:58

HazelWicker, thanks for this. Did they initially give you an 8 week timescale when you applied for the conditional order? I feel like this 8 week thing only started around December, previously it seems like people were given 4 or 6 week timeframes...

Bettybethinking · 24/01/2024 22:54

I applied today and have been told it will be 'by' 8 weeks time to receive notification of the conditional order court date. Let's hope it's sooner...

cm0301 · 25/01/2024 15:05

Fingers crossed. I don't understand why it all has to take so long 😕

Just to give everyone some reassurance - finally heard back today (just under 4 weeks after initial application, even though they said it could take up to 8) - conditional order will be read out in 2.5 weeks :) So not that long of waiting at all!

I split from my husband back in April after i caught him cheating on me. he left me with loads of debt and i struggled to pay rent. i couldnt afford to even eat. he agreed to a divorce straight away but kept saying he couldnt afford to pay a penny towards the divorce (even though he was living rent free at his mums). Anyhow i borrowed money to pay for it myself last august. Today i was able to apply for my conditional order . i woke up at silly o'clock to go online and submit. i then got an email stating i would hear before 23rd march. The wait to get this far has been so unbearable, now i will be looking at another 3 to 4 months for it to be finalized. that means a full year of him being my so called husband after what he has done to me. i just need to get this over and done with so i never have to hear from him again and forget he ever existed.

cm0301 · 27/01/2024 12:09

I feel for you. You wait so long and then to be landed with another wait is just too much. It seems like people are getting them a bit quicker, but not quickly enough!

Hi
On 1st Feb I'm able to put in a conditional order sole application for civil partnership dissolvement. I understand there's a 8 weeks wait ish before an initial court hearing...is this definitely 8weeks????? Noone tells you about this wait!!! And after it's read out do you then wait 6weeks 1 day or you then apply for the final order...its super confusing.. And after that does the final order take long??? Thanks everyone...

cm0301 · 30/01/2024 23:23

I think people are finding it's not quite that long, a few have said recently they got a date through in about 4 weeks, but it was for another couple of weeks later - so potentially 6 rather than 8 from applying to getting the conditional order. You're right though, there's no mention of this wait is there! And then it's a another 6 weeks and 1 day from then til final order - but it seems like that is pretty quick. I'm only a couple of weeks into the conditional order wait, time seems to be passing so slowly.

Thank you...its sooooo frustrating! Even the 20weeks have been slow. So your 2weeks in, so that must mean your in the initial 8weeks, I do hope you're not waiting long and hear quickly. It's the not knowing that drives me mad...I just want it done but have to find patience and peace. Good luck and ty for replying.

Bettybethinking · 31/01/2024 08:31

I am 3 days ahead of you - I applied on 24/1 and got an 8 week email. I will update on here when I get the date through. I think it's different in different areas (I'm in the North West) but this thread is my source of truth! So frustrating but it will happen...

DiddlyDiDi · 31/01/2024 15:56

i think they should let you which courts are actually dealing with it. my current partner is also getting a divorce. his ex applied through a third party and he never gets any updates. i have worked out that his ex could of put in for the conditional order christmas day, so its also a waiting game for him

Sunshineandwaterfalls · 01/02/2024 02:09

Sorry for what you’ve been through. I am in the same situation although I have two children added in so getting him out of my life feels impossible

cm0301 · 02/02/2024 15:03

I have just had an email through to say that the application for the Conditional Order has been accepted and that it will be read out in court on 21st Feb. This is exclactly 1 month after applying, and several weeks sooner than the original response implied! Fingers crossed the same for everyone else that's waiting!

OP posts:
Bettybethinking · 02/02/2024 15:10

Thank you for the update. So you applied for the conditional order on the 20th Jan? That is much better fit you than you feared - great news :-)

muffin2829 · 02/02/2024 15:13

This is great news for you, very happy and I expect you and we'll relieved 😌

gano · 02/02/2024 15:20

I've found it's not taking as long as they say. I applied for a conditional order on 18th Jan, and received an email this week advising that the judge will pronounce the order on 13th Feb. I'll then be able to apply for the final order on 27th March.

cm0301 · 02/02/2024 18:15

Yes, applied 20th Jan, going to be heard in court 21st Feb, can apply for final order 2nd April. Now the only thing slowing me down is waiting on the CETV for my pension - applied for it in September! But that's a whole other saga!

OP posts:
Bettybethinking · 02/02/2024 18:18

I'm also waiting for that! Mine is from the Teacher's Pension scheme... I put in a formal complaint about the delay. Heard back today that they are now starting to process them, but still no timeframes... :-(

Bettybethinking · 07/02/2024 09:06

Just had my date. So conditional order applied for on the 24/1. Was told I'd get an email by the 20/3 but got it today -7/2. Will be ready out in court on the 23/2 and I can apply for final order on the 6th April. So in my case the 8 week timescale to receive the court date was an overestimate by about 6 weeks. Hope it's the sane fit others.

DiddlyDiDi · 07/02/2024 12:32

Wow that's good. I applied 3 days after you so hopefully I should hear something soon
