What happens if ….

I don’t make the next move? My husband has spent a substantial amount of money during our divorce which were out savings meaning I will not be receiving half of it. My solicitor said his half of the settlement should now be adjusted to account for what he has spent. He has refused. What happens now? Should I just sit tight? He’s desperate to re-marry his girlfriend. I just want what’s fair. I put in half and need half or I won’t be able to afford a flat. Renting is more than a mortgage so it isn’t even an option.

whatever he has spent extra to you - take out today

If he’s desperate - then use that to your advantage

Here you go. It was your joint savings and you’re still entitled to your share. Your solicitor s correct of course. A court will sort your exH out.

I can’t because he spent it all.

So you’re hoping to get more from sale of property?

I have no money to take him to court, that’s the trouble. The divorce has cost £31 000 so far. I am all spent up.

Yes. We agreed on 50/50 after two years of him not allowing it. I have taken out loans to pay for my solicitors fees whilst he used our savings unbeknownst to me. So I have in effect paid half of his legal fees.

That's shonky, my oh did this but it was taken from the sale value at the end so he didn't get it twice iyswim

Ask your solicitor to put a first charge on the property which means when the proceeds of the sake come in they get X amount first

This might be able to help you - it says here something about a freezing order https://iamlip.com/financial-terms-financial-court-orders-explained/
It says that if you apply for it, it can prevent your ex-partner from depleting, hiding, using, or accessing etc any marital asset including bank accounts and investments. Further down in same section as Freezing order it mentions an account freezing order (AFrO). Have a read, I think it tells you how to apply for one - scroll down to 'What is A Freezing Order' which is around halfway down.
Hope this might be able to help you stop your partner from spending anymore of your savings xxx

He has spent all of the money so there is nothing else he can take. I have spoken to our mortgage provider to make sure he doesn’t change out policy though to protect myself.
