Taking ex's name off mortgage

Currently in the process of remortgaging as fixed term coming to an end imminently. Stbxh are in the process of divorcing, I have applied for the conditional order.

I am going to buy out stbxh of his share of the house and take his name off the mortgage, I have already been approved to take on the mortgage in my name only.

The bank has just asked for a "court order/separation agreement". As far as I can tell, these are not legal documents. I have a solicitor will be drawing up the financial consent order, but I don’t know when that’s going to be yet. But the mortgage advisor said that he needs these documents to proceed with the remortgage. Does this mean I can’t remortgage until I get this “court order”? Apparently I can draw up a separation agreement myself?

I wish I had known I needed to provide this because now I am going to be stuck on a SVR for longer 😭

If you can draw up a separation agreement yourself then I would do that.
