Husband has made an application, London courts. Children are 2 and 7. Before he left, I did slightly more childcare (and all doctors, dentists etc). He left nearly a year ago, was off radar for a few months, has seen them at weekends and once in the week since. He’s made an application for equal care. I can probably buy him out of family home which is much closer to 7 year old’s school than where ex will be living, and I want to keep existing childcare for 2 year old whereas he wants to change it. I want an outcome that’s more like 60/40 (him having 40% ie EOW, overnight in week, half the holidays) because I think it gives more stability/continuity when the children are so young. I have legal advice but keen to hear any recent experiences of what courts are deciding and what the factors in that decision are…?

We both work f/t, he has been inconsistent in seeing children recently due to work or going on hols with new partner.

From what I'm led to believe OP and what I read anecdotally on lots of MN threads is that 50/50 is absolutely the starting point - will little negotiation being able or the courts caring how much or little the other parent did previously. Even if they are a domestic abuser they will get 50/50. The courts are holding a fathers "right" to 50/50 as paramount it seems even though lots of studies and children who are now adults themselves have said it wasn't in their interests.

Sorry I don't have first hand experience of this one x
