Ex Husband and CMS

Hi
I was wondering of anyone had experince of the following.
My ex and i split 18 months ago and over the last 6 months my relatinship with my daughters has deteriorated (13 & 11). My ex and I have split assets etc but never agreed a formal child custody and has always been fairly relaxed and since January my daughters have been spending more and more time with my ex.
He wont discuss childcare arrangements "they dont want to stay with you", he wont go mediation "it is your problem not mine", he is refusing to help build a relationship with them. There has been no infidelity, no abuse, no domestic violence but he has no demanded £450pm for maintenance which I cannot afford. I have asked him to arrange formal chidcare but he wont and is reporting me to the Child Maintenance Service. I want the children 50/50, he knows that but still refuses to discuss anything but he is saying that as they are stayng with him the CMS will just deduct the money from my wages but he has not given me chance to see the kids. When the CMS get in touch, will they look at the situation or just deduct the momey from my account?

They will look at where they spend their nights and calculate based on that
un the first instance they won’t take direct from pay but will tell you what they think is owed

have you applied for CAO?

unfortunately at their ages (esp 13) their wishes will be considered

No there is no CAO in place as it was an amicable split until a couple of months ago. I am trying to get one in place but he is refusing to meet or go to mediation. I dont want to go to court at all, but feel that is the only option
