I need him to go

I need him to go. He's horrible and snappy at everyone. Yet it's everyone else's fault. I'm at breaking point. I'll be so much better on my own. The kids will be happier without him here. I'll be financially fine on my own, I can cover the mortgage and bills comfortably.

But he won't go. The kids wouldn't want to live with him, so I would end up with them full time. He has a good income so I'd get a decent amount through child maintenance. He said I'll have him over a barrel and he won't be able to move out. For context, he is WFH, so could go back to his parents. He said he'll only go if I buy him out. I can't afford that. He can't afford to buy me out. So I'm stuck. And I don't know what to do.

if not, how do you own the house? Joint tenants or tenants in common?

is there much equity ?

you will need to work out what he is due but the answers will depend on marriage or not and other factors

Are you expecting him to move back in with parents and leave you with his share of the equity ? Personally, I’d want my equity out of the house to enable me to purchase my own property. So I can see why he would want this too.

Put the house on the market? See a lawyer and start the financial negotiations to determine who gets what.

He’s not going to just move out because you want him to. Why would he? It’s his home and his asset too. He’s not going to give it to you off his own back.

See a lawyer and start proceedings to divorce, if you’re married. Then once either of you can buy the other out or the house gets sold you can live apart.

I'm confused - you both own the house and you want him to move back to his parents and leave you living in the house but without buying him out? So basically he gets nothing from the house he jointly owns but still gets to pay you child benefit? Unless there's a massive drip feed coming, that's awful.
