Financial order when you both have nothing

STBXH is dragging things on as much as he can, and now we're weeks away from being able to apply for the conditional order, is trying to hold up the financial side of things.

I'm looking for a clean break order. He's looking for... Well, it's not exactly clear to me what he wants! Mostly just going on about how unfair everything is, poor him, etc. He's got no solicitor, and doesn't seem like he wants to get any legal advice.

He is on benefits, no savings, no permanent address. He didn't work during our marriage, but thinks doing some DIY entitles him to something somehow. I have a small amount of savings (made after separation), a job (although not massively stable), and a lot of credit card debt (most of which accumulated during the marriage, as I was paying for everything), and currently renting. No shared assets or pensions.

What is a judge likely to order, if it goes to court? I can't see him cooperating with mediation. I've got a meeting with my solicitor next week, but it's just on my mind and worrying me!

How long were you married OP?
he sounds like a deadweight, I’m happy you’ll be free of him and can face a future without him dragging you down

We separated after 2.5 years, so not long really.

Yes, absolutely cannot wait to be free of him! Hate that he can hold things up so much.

Depends - how much savings have you got and how much debt have you got and how much does each of you have in your pensions.

Hi I’m in a similar boat
he has debts and lives with parents

mom on benefits working but no savings
just living on what I bring in
socially houses

I got a fee waiver for my divorce application

im taking it all one step at a time and intending not to spend a penny to untie myself from the abusive ex

he’s not responded to the divorce

i think I’ll be asking the courts for a clean break order but I’m learning as I go

Do you own a house? It was a short marriage so I don't think he will be entitled to as much as he would be had it been a long marriage. I thought with the new divorce laws things can't be held up by one person dragging their feet.

That’s what I was told
if my husband doesn’t respond to my application by 1st April I will be told how to push it through

then there’s a mandatory five month wait then I can apply for the order

@Chowtime no pensions, and debts are about three times as much as savings. @Viviennemary no house or property either. When I say nothing, I mean nothing! 😂

@happysingleversary sorry to hear that you're going through this too. I think we'll be able to keep pushing things along, but he just makes it so much more difficult and expensive. He doesn't really respond to things properly, just sends back a bunch of nonsense!

He might try and offload some debts to you
i think mine will

i don’t intend to use a solicitor
ill just be arguing my very straightforward points if he wants to waste money on super expensive solicitors as he is with family court

@happysingleversary not a very good income, but not low enough to get any help. All the debts are in my name - thought he might be happy to go with a clean break because of this. I know trying to get any money out of him is pointless anyway.
