I posted before about if my partner was offering a fair deal, thank you all for the comments it confirmed everything I was thinking.
The short of it is I have one child he has two, all under 16 and from previous relationships, we both have a good salary (him over 100k me just under). He offered his ex wife 100% of the house (equity 450k, worth 900k) if she pays the mortgage, he stays on the mortgage, 50k which he has already transferred from another property sale, 50% of his pension and the lease car which he will fund (an expensive one) and 3k per month global maintenance (which includes child maintenance). He will then retain the rest of his salary and work to come out of debt (this has taken 3 years and he is now in severe tax debt as he has covered all costs including full mortgage).
She accepted the offer and it was about to be finalised, but she then came back and asked for more… she wanted him to pay the maintenance in line with inflation, and pay capital gains tax when the property is sold in 10 years. It’s ridiculous because neither of our salaries have gone up in line with inflation, and in a few years he would be paying such a high amount after basically giving away everything. The CGT would be over 80k, on a property he has no equity in and is only remaining on the mortgage so the kids can live there. She is on minimum wage, works part time and cannot take on the mortgage. She does have a lot of degrees and is a doctor but has said she cannot increase her salary (not sure why, I did it). She has also suddenly allowed me to be around their kids, 2 years later, which has been really nice but I worry this is for financial gain now (if we get a mortgage together).
It’s unlikely he will even be able to get a mortgage alone in London (where we work and both live but separately) whilst being on another one, and in debt without having to give in to this demand.
Anyway, it’s now going to court for the final hearing. His solicitor advised him not to even entertain the initial deal, but I think he may now have realised this will never stop and he should just try and fight this. The only sad thing is all of this money could have gone to actually better their kids lives, instead of greediness. Their legal fees have cost over 30k so far.. I can’t wait until this nightmare is over but it does seem like an end may be in sight.
