Hi, ex and I have agreed a settlement amount. The solicitors have just sent this to the court, please can you tell me how long it will take to be passed by a judge and I will receive the money?
I'm Manchester based if that makes a
Difference

shouldnt take long, the DJ's get through the paperwork pretty quickly. Ours took less than a week to be sealed. Unless its deemed as being heavily swayed in one persons favour they tend to get through them quick. Hope that helps

The courts don’t look at it until your conditional order has been made (assume if solicitor sent in then you have this). The court will “Seal” it as Part of process to issue your final order. So until you can apply for final order (min 6 weeks post conditional order) they won’t “seal”. Mine came within a few hours of my final order (what was the decree absolute last year )

Re receiving money - that depends on where money is. How long is a bit of string? If it’s in your name in savings you’ll have it straight away , if it’s in a hous3 yet to be sold - it’ll be after sale completion. If it’s in savings in ex’s name it’ll be when he gets round to sending it to you based on whether it’s in a savings bank, in vestment that need to be sold, a business that needs to wrap up, a pension sharing order. Etc etc.
As far as I understood from doing mine, the consent order just says who gets what, it didn’t specify when to a date. It depended on when house sold etc. in truth a lot of cash savings we had we moved between us prior to courts “sealing” the order anyway, as wed already singed and solicitors witnessed. We just had to complete sale of house to shift final monies-wed just exchanged but it sale could and do fall through even at that stage, so wed have to have sat it out longer in that case.

Mine has just been approved. It took less than a week. It’ll take longer for STBXH to get the money though as I now need to go through conveyancers etc. There was a time limit attached to ours though. Is there not in yours?

Fab thank you all. The divorce was finalised a couple of years ago so this is separate to that.
He has the money in a bank account waiting to send so we are waiting on the court to let us know when it's been approved.

Just checked it gives him 28 days once approved

Hi I'm waiting on the judges decision on our financial order, it isn't a 50/50 split as he's demanding 10,000 more than he's entitled to, I have lived in the house since our divorce 13 years ago along with our 2 grown up sons I'm not going after his pension or anything else, so do you think the judge with challenge the order, many thanks

Can i ask, adding to this. Once the court order is approved, can the funds agreed be transferred prior to the final order?

Timeforachange2023 · 20/01/2023 20:28

Once the judge approves a draft consent order it becomes sealed and the final order. If you’ve applied online and the order doesn’t have a pension sharing annexe, then it will be available straight away.

If you are to receive a lump sum as part of your agreement, does the order not state when it will be paid?

There is a 28 day appeals period for orders. It might be you would need to wait for that to elapse before you receive your ££.

Timeforachange2023 · 20/01/2023 20:31

If it’s an order you’re asking the court to make by consent, why are you hoping a judge will refuse to make it?

Generally speaking, the order will be made if its by consent, especially if you’ve both had legal advice and the draft order was drawn up by a solicitor.

@Timeforachange2023 thank you

Lisa7070 · 23/01/2023 12:16

I agreeded because he intimidated me , and I felt like I had no option, now I regret it , which I had stood up to him !

Tometoyou123 · 13/02/2023 20:40

@feckingknackered I am just in this process, how long did it take?

feckingknackered · 25/02/2023 19:53

@Tometoyou123 I'm sorry I've just seen this. It's still ongoing for me, we haven't agreed an amount as he hid his savings and then disclosed them (or some of them) to the solicitor just before it was being sent off to court.
He's purposefully is dragging his feet.
