I have the two kids all of the time, he has one of them one weekend a fortnight. Two questions:

Regardless of any other shared financial circumstances, he should be paying CM?

He says I could go after it, but they can't MAKE him pay- is this true? Or would he be taken to court?

Does he have a paying job? Or is he self employed/unemployed/retired ?

Well they haven’t been able to make my ex pay so depends on his situation, self employed/ cash in hand etc and no they don’t do anything if they don’t pay....

If he has a job, paid PAYE on the books then yes they can make him pay... otherwise as many folks will tell you he will get away with it if he wants to. I'd still give it a go though CMS is useless but occasionally hits gems!

What does “regardless of any other shared financial circumstances” mean? I think it’s more complex if you have a mortgage together and he’s paying half for example or he still pays all of some joint debts. Also hard if they are self employed.

They can deducted it from his wages if he's PAYE.

If he's self employed they cant. Yeah I know, its fucking ridiculous that they can't find a way to make self employed parents pay CM in this day and age.

Realistically if he doesn't want to pay, it's very simple for NRP to find ways not to.

To be honest, it's very unlikely that he will get taken to court.

My ex said that too. It was not true. Eventually his employer had it taken out of his salary. It was sent to me about 3 weeks later. It was regular every month.

what other shared financial circumsrsnces? I mean if he’s paying all your mortgage and bills as exsne thdn might not be so appropriate to claim….
