Financial consideration

Just looking ideas on how this might be looked at by a judge......I am waiting to see what my ex does before I seek specific advice. And curious of the knowledge here for now.
Applying for divorce, on form he wants to 'apply to court for financial consideration'.

My ex wouldn't leave out home until 5 years to the day we were married.So 5 year marriage. I owned 13 years prior we lived together less than 5 years him having kept on his flat for a period. I funded myself the full 5 years we are now separated and our one child now age 5. I only applied for maintenance last July which I now get. In the time we were together there was minimal and at times zero contribution to the household. History of financial abuse however I know this isn't considered.

I wonder how this type of situation is generally viewed.

I believe the courts don't consider the reason for divorce however I wish they did!

They won’t award a greater share of finances in the settlement to the partner who made the greater proportion of financial contribution to family life during the marriage to “compensate”, no. However, as you owned the home for a long time prior to marriage, the marriage was relatively short, and you are primary carer for your DC, this will be taken into account when determining the split of the house equity, which will very likely be in your favour.

The overall settlement will depend on a range of factors and you need legal advice.
