Hi,
Does my stbx have any claim on my future salary/pension after our separation date or decree absolute date?

You need to employ a solicitor, not Mumsnet. Sorry to be abrupt but it is essential for you

millymolls · 05/10/2021 22:42

There’s potential claims until such a point a clean break consent order is signed so yes potentially

arethereanyleftatall · 05/10/2021 22:44

Possibly.
My exdh pays me spousal maintenance so I guess that's what you're asking.
Depends on everything.

RoseMartha · 05/10/2021 22:46

Depends if you have done a financial order with clean break written into it.

The financial order is better done before the absolute.

I have a solicitor but they haven’t said what happens to salary after the divorce. I’ve emailed for clarification.

Divorce is separate to financial arrangements. So nothing will happen on divorce.

If you get a clean break as part of the financial arrangements order, it should limit any future claim. There can be caveats though, such as death during period of spousal maintenance can trigger a claim in the estate.

CosmicUnicorn · 07/10/2021 18:48

Ok, thanks for that. 😀

@CosmicUnicorn do you have a consent order? If you do he has no further claims. If you don’t then you need to sort that out. You should speak to a solicitor about this but im divorced and consent order still not done and im looking onto sorting it asap.

@SchoolNoMore
It’s all in the hands of the solicitor atm. He inherited another property after the date of separation which is not going to be classed as a marital asset. I have the youngest child 100% of the time and the eldest probably 50% (will be going to university next year, hopefully) and he doesn’t pay me a penny. I’m worried he will touch my future salary.
