Finalising finances after absolute

I hope someone may be able to give some clue as to what to expect before I call the solicitor.

We separated in 2015, i petitioned and we got the nisi in late 2015, absolute in June 2016 after changing deeds and mortgages on a flat and the house (he got the flat, I got the house). All other assets and liabilities were in sole names and we were happy to just stick with that. The whole thing cost £1000.

We're still friends and he is planning to pursue a dream which I believe will end in disaster.

I've recently redone my will and set up LPAs, basically getting my affairs in order (we're both late 50s, 3 adult DCs). I've told XH it bugs me that we never put our financial affairs to bed legally, and he agreed to go halves with me in doing so. I have the name of an appropriate solicitor.

When I call her, what is the name of the document I want her to draw up, and how does it protect each of us?

Do you mean a Clean Break Order? It means that neither of you have any claim on the other in the future, that a line is drawn under it.

That sounds about right, thank you! Should he get separate legal advice? Are their forms to fill in?

Sounds as if you want a consent order with a clean break clause in it www.stowefamilylaw.co.uk/blog/2020/09/22/what-is-a-consent-order/

It's a very good idea to get one, esp as otherwise it's possible for one of you to make claims against the other in the future. That might seem unlikely but probably not a risk you want to take!

Thank you both, that's really helpful
