I am about to separate from my husband.

He had an alcohol problem and has been given far too many chances. Tonight I have come to the conclusion that tonight it enough and I cannot do this anymore.

I have reached the end of my tether with the lies and the anxiety surrounding his use of alcohol and trying to judge whether he has had a drink on his way home or not? So I'm done!

I have a question, it is a relatively new marriage, less than 3 years. The house we live in is mine from my previous marriage. He is not on the deeds. He says he won't take anything as the house was mine.

Is this the case? I can probably afford to keep the house and continue paying the mortgage. I did before.

However, does anyone know where I stand legally?

You should be able to include a consent order with your divorce for a clean break where he agrees to not having any claim to the house for the reasons you have shared here.

A judge may query it, in which case he / you would need to reply stating the reasons and that all parties understand the implications. But it should be fine.

If you both consent to an arrangement you work out between you then it's usually rubber stamped.

The shorter the marriage the more likely it is that the court would expect finances to reflect "who owned what". As a marriage gets longer, there is more likely to be sharing. So, don't delay!
