How long does CMS take to set up?

I'm unfortunately still living under the same roof as exDP nearly 2 years after we split up.

I can't stand it any more & want to move out. He is the higher earner but won't move out.

I will need maintenance to help me pay rent . We have already agreed the children will be with me EOW, 50% of school holidays & a midweek night.

If I start a claim, how quickly will it come through?

Will soon to be ex not come to a private maintenance agreement as that’s much quicker ? That’s the way CMS will encourage you to try first .

He will would, but he's very controlling & manipulative. I just want to leave & rent somewhere. It's taken 2 years to get to this point & we are no further forward in terms of a financial settlement.

It would seem your ex is having the children more nights a week than you, which would mean you ended up paying him maintenance. Sorry to be the bearer of bad news.

I put an application in for CM in April - I have been told to expect my first payment on 1st August if that helps.

Just crack on and file for CMS it can take quite a while. About 3 months ish.

@ProseccoThyme if you're still living under the same roof and you won't be out of the house a week after you've applied don't bother applying. I'm unfortunately under the same roof as my ex husband and we have a court ordered CAO, I stupidly made an application mid June 2021 and paid £20 for it to be debited from his wages directly and I got a call from CMS stating that they cannot process my application as we're under the same roof. They told me they could only put a hold on the application for a week. I would hold off until you're not in the same house.
