Such long delays!

Has anyone else had huge delays in their divorce proceedings? We filed for divorce a year ago now and still nothing back. My solicitor sent off the acknowledgement of service on the 23rd of March last year (2020) which was the day before lockdown, and the courts have said they never received it, they have proof it was sent and solicitor re sent with a covering letter before Christmas saying they must have lost it etc etc. I'm just so sick of sitting in limbo.

Does anyone know now how much longer this could go on?!

We also started the process earlier this year - can't remember exactly when but similar to you. Received decree nisi around mid-September and now waiting for decree absolute which will hopefully come through in the next few weeks... yours sound slightly longer, so not sure if maybe they did not receive? 🤔

However I completed the acknowledgment of service online and have an online account where I can check where we are in the process.

I do also feel like it has been taking ages and hate the limbo too! 😭

Thanks for your reply! Well you seem to be well ahead of us! So frustrating though!
My solicitor can only work out that because it was received by the courts the day of lockdown everything was all up in the air and it got lost!! I can't believe it's only now this has been realised, it's so frustrating.

They lost my paperwork and I've heard lots of similar stories. I wouldn't rely on it turning up if it's been a year, sounds like your solicitor is following it up at least so fingers crossed they accept the proof it's been sent at least.
They are just so busy and things were painfully slow before covid. The affect on people's lives is awful. Fingers crossed you can apply for nisi soon op.

Loracina · 03/01/2021 17:44

I'm not sure if that is possible but could you maybe submit the application again?

boymum9 · 05/01/2021 11:29

@Tiddleypops oh really? Did it ever turn up? How long did it take? My ex h has caused so much grief the last couple of years and I feel like I'm sitting in limbo unable to move forward in life until it's finalised because he still thinks he has some level of control over me, house, what I do, where I am, what I tell him, it's awful.

@Loracina I'm not sure, I'll have to ask to solicitor!

No, it didn't turn up, I had to resend it all. The stuff they lost included my original marriage certificate, which I then had to replace with a certified copy at my own expense. It was a proper shit show!

Definitely get your solicitor on it, you've waited long enough!

In fact I'd contact the court yourself. If your solicitor has just written to the court, then it's likely that the letter/email will just get lost or sit in the months long queue. If you call or use the chat service, expect to be on hold for 30 mins or so, but they do eventually answer. It might be your quickest/least slow way forward.

Dp's was sent off in October and got degree nici in December, absolute should be granted next month. I've not bothered processing mine as the courts are backlogged, not bothered by paperwork

I started the on-line process in March or maybe April last year. I got an automated acceptance and reply that said things were being delayed considerably by Covid. Fair enough, I thought.
Then it went quiet for a long time.
In the middle of August, they wrote to me to tell me that proceedings had now been issued to my OH.
Nothing arrived and eventually, at the start of October r they said my H had not responded within the seven days. I replied to say no proceedings had been received.
This triggered a request for me to provide the case number ( even thought his was included in the email they had sent to me and in my reply!) . I replied with all the case numbers in bold 😂
Dec 8, they finally sent out duplicate documentation. H responded within the seven days and just before Christmas we were notified that the online submission had been sent to the court and that we would hear in due course whether the court would agree to a Decree Nisi.
Much to my astonishment, given how slow everything has been to date, I heard yesterday that the Decree Nisi will be read out on Jan 22nd!!!!
