Consent order problems!!!

user1465562572 · 08/12/2020 20:36

So me and my now ex husband are divorced a year now.
We agreed our financials mutually without any discord and I have filled out all my personal financial information and sent off to his solicitor except his solicitor is refusing to send my solicitor a copy of his financials and just wants to go ahead and file it with the court !! Despite my solicitor asking multiple times for this!

Now his solicitor is demanding my mortgage account number, the reason being to ‘speed up the process’ at the court. I don’t want to give it because she has not sent over his financial info for me and my solicitor to review. And he has let slip he has a pension that I didn’t know about.

So can his solicitor really refuse to send over his financial info? Seems one sided to me, he knows all my financial business and I don’t know his. I’m starting to smell a rat!! And can she really demand my mortgage account no. What relevance is it for her/him to have?

I'd get on to your solicitor and see what he or she says. I'm swapping financials with my STBEX but we are each supplying our solicitors who will do the swap.

Might have been easier to do it that way?

His solicitor already has my consent order signed and dates but I haven’t received my ex husbands.
My solicitor has asked once again for his solicitor to provide his financial details and his signed consent order but she won’t sent them for me and my Sol to see Confused. She just wants to file it all at the court. My ex hub has stated no beneficial interest in the home and we Doing a clean break . Hope that makes sense

Absolutely not. The D81 includes a statement that you have seen the other side's D81 info. I increasingly wont even release the page with that bit signed until I have had the other side's form, because of this kind of nonsense.

The order can't be validly made unless you have exchanged financial info.

Thank you MrsBertBibby , you make perfect sense. I haven’t seen form his D81. I phoned my solicitor up today and he said she cannot file all the paperwork at the court or the $hit will hit the fan!! And we can’t do anything our side till she does provide it and all we can do it keep asking.

Well, you can threaten to issue Form A, of course.

I will bear it in mind, thank you.
