Desperate to move out

I've been separated following his affair & living under the same roof now for nearly a year.

Ex is about to have major surgery next week. I cannot bear the thought of having to provide any care for him & want to move out quickly with DC (11&7) if I can find somewhere local to rent. He won't be able to drive for 6 weeks.

He wants to do 50/50 in the long term (I'm the primary carer & not in agreement about this).

We are in a part of Scotland where there is no indoor visiting (he was hoping his parents would do childcare for him)

I would plan to claim child maintenance & would still pay my share of the mortgage back. I'm suggesting he does EOW, maybe 1 night during week (but he won't be able to drive/walk to school initially).

He probably won't want to agree to this but I feel I need to do it.

Can I just go with the kids? How long would CMS take to set up?
