Divorcing dh but still living together

I posted in AIBU but realise I should have posted on here!
Started divorce process in Feb but still living with dh as he has nowhere to go (family living abroad).
Just wondring how many others are in this situation.

Ah ok so if I paid that to him I could stay in the house?
With the guarantor would that mean I could stay without paying him off?

You would need to pay him what he is owed as his share of equity. But if the children stay mostly living with you you might be entitled to more than half the equity in order to house the children. You would need to pay him his share and also pay the mortgage. You might be able to extend or increase the mortgage payments to cover paying him his share, but that would depend on whether your mortgage co agree. I.e say he was owed £20k, he gets that. paid from the mortgage, you add that amount to the mortgage you owe.

I don’t know if you are using made up figures but if the house is worth £400k and all you have is £40k equity then best case scenario is you need a £360k mortgage. Is that right ?

How big is your current outstanding mortgage?
