Divorced because of ex husbands unreasonable and criminal behaviour for which he has now been sentenced We put a consent order in for sealing by the judge in November we had both agreed to 75:25 split me:him of savings
Mainly because I have our two children 100% of the time they spend a few hours every other weekend with him as he only has supervised contact
The judge refused the order at the end of Dec and came back with questions
1.where do kids live 2. Why is it inequitable

  1. Have both parties had legal advice- which we have
We responded early jan and we are waiting for the response any ideas if it’s likely to be refused again and if so what happens then? We are both in agreement to the division of money

Mine has been refused twice now, we have explained why we have come to our agreement in depth. I have requested a hearing in a local court so that we can both attend. Unfortunately it will just come down to the judge's decision on the day.

I was extremely stressed about it but am trying to detach - I cant change the outcome.

Flowers it is a pita.

Yes, it takes account of the fact that XH had a huge sum of cash from a house sale to pay off career related debts in the last few years and the fact that my family gifted me much of the equity in our home to allow it to be purchased at all (in view of the equity XH had used per above).

There isn't even the amount XH took out left in the house.

As I said I was finding it immensely stressful but I am trying my best to detach.

Yeh I could do with this just being agreed as waiting to exchange on a house I have no idea if it makes a difference if I have exchanged on a house before I have the order ?
