Mesher order

I have read a lot on what a Mesher order is and although there are issues with it I have some questions you may be able to answer.

  1. How common are they now?
  1. There are lots of mothers that apply for them, can’t a husband apply to?
  1. I have no chance of getting a mortgage to continue living in the MH. My credit is very poor and I have debt that I has been passed to creditors (I hid from husband).

I’m in a pickle I know but just seeking information for now

I believe clean breaks are preferred but nesters are still awarded in cases that need them
Usually however, the person staying in the house would be expected to pay for it, including the mortgage and would therefore need to pass lender affordability checks. If the other partner is very high earner this might be different and some spousal may come into play

Either party could request - usually person housing the children

A lot of factors will come into play not least earnings, equity, other assets, length of marriage, ages of children etc etc

Also to consider is what happens down the line. Eg say a mesher is awarded now which has 12 years till children reach 18. Then in 12 years time house prices are much higher, and you are 12 years older and may need to sell to buy out the ex share at levels you can’t afford and now can’t get another mortgage ?
