Divorced but no paperwork??

Hello,

My exh is the petitioner in our divorce (which is a simple, no assets, no arguments affair) and he has had a letter to say we're now divorced.

I haven't signed anything except a court document months ago to say I definitely wanted a divorce.

Exh says he's signed a decree nisi a couple of weeks ago but I didn't receive anything and then he called me today to say we're divorced.

Surely I should have received something?!

Can anyone help?

You should have had a decree nisi too. The process is here

www.gov.uk/divorce/apply-for-decree-nisi

Presumably your husband applied for the decree absolute. There would have been no need for you do anything for that to happen, but you should also have received the decree absolute.

ragged · 11/02/2020 19:50

Have you seen any of the documents he said he received?

LatteLover12 · 11/02/2020 20:40

Absolutely nothing @ragged

I thought it cost like £550 to self-file divorce. Has one of you paid £550?
(in England, I guess)

LatteLover12 · 11/02/2020 21:16

He's paid via his solicitor @YeOldeTrout

You need the paperwork to move on in life. I've been asked countless times for my proof of divorce. Not least when I gave notice to re marry.

Thedeadwood · 11/02/2020 21:29

Did you get paperwork to notify you he’d filed for divorce when he started the process?

Itsallchange · 11/02/2020 22:25

My exh received all copies of the divorce paperwork sent directly to him by the court, my solicitor received mine and sent it to me the gap between decree nisi and absolute would have to be 6 weeks and 1 day you can ring the court to discuss

Lexipar · 12/02/2020 14:37

When my ex decided to file a divorce, he decided to do online divorce and I didn't have much of paperwork. However, after the case was closed, I've got the file with all of things enclosed. And I also had several notifications on my email and ex warned me that his solicitor might meet me for submitting several papers. But later on I had only an email and my ex's solicitor sent a letter with papers about marriage dissolution, tho

You have had some paperwork? The court stuff? You haven't moved since the stuff that you did get have you? Seems that the whole divorce has to go to the same address you had when he filed (and takes months) so I am having to pay royal mail to redirect for the whole duration cos they can't do it. This despite that more than half of people will move during divorce... These days it's only junk mail and divorce stuff being redirected...

LatteLover12 · 18/02/2020 09:09

I have moved @Otter71 the solicitors involved we're told more than once. Do you think it's that?! Oh no 🤦🏼‍♀️

Hi! It will be because of your move. I'm recently divorced (ExH was petitioner). Received the Application to sign (if you kept a copy this will have the case number in the top right corner), then a letter telling me that the Decree Nisi was granted, and finally a letter confirming the Decree Absolute. Don't worry though, you can get a copy..

www.gov.uk/copy-decree-absolute-final-order

incywincyspiders · 18/02/2020 10:06

I got an email telling me my divorce was complete and just an attachment of the decree absolute.

Otter71 · 18/02/2020 10:49

If you apply online it's emails but if you apply on paper it's snail mail. Unfortunately if you are respondent you don't choose...

LatteLover12 · 18/02/2020 11:48

OMG @sarah12398 thank you so much!

Will try this now, fingers crossed!

What about financial consent order - you still need one of those

LatteLover12 · 18/02/2020 13:12

I've done it! Spoken to a real human who confirmed I am definitely divorced! Thank you so much @Sarah12398

I've had to send a follow up email to get the decree absolute but it's all good because I AM DIVORCED!!

@latteLover12 Brilliant news. Congratulations!! Flowers Wine

Otter71 · 18/02/2020 13:39

Well done. How. Long did it all take start to fiñish?

LatteLover12 · 18/02/2020 15:58

Well I chucked him out we separated in July 2015 @Otter71 but ex DH finally filed for divorce in January 2019 and I received the court paperwork in the summer.

We were warned at the time that even the simplest of divorces took 8-10 months in the courts because they're so busy.

So I suppose it took about a year to get to this point.

Life has moved on and improved immeasurably in the years that have past so I'm feeling very happy today. 🥳🥳🥳🥳🥳🥳🥳

Well done. Hopeful that mine will be over soon. At the nisi stage after filing at a similar time. Waiting for consent order.🙄😪
