I went to divorce my husband. We have an 18 month old kid and a house together, where we pay all bills and mortgage equally. He keeps saying that if I file for divorce I won't get the house. I don't want to house - happy to sell, but I would want him to move out once papers are filed. Can he be compelled to move out? Me moving and setting up with a nursery bedroom for baby and all is a pain. Happy to move once we are done with the divorce and sell. Also I can buy him out but he won't agree out of spite.

You need to talk to a solicitor

If you own the house jointly then no he can’t be forced to move out, and why should he

You’ll need to see a solicitor, start proceedings, attend mediation and reach a settler with regards finances and child arrangements

Until then he can remain on the house as can you. Of course he may agree to move out
