Joint mortgage post divorce

STBXH and I own two mortgaged properties in joint names and I'm hoping we can split them so we each take one.

However, I can't get the mortgage solely in my name on the affordability criteria.

So I'm hoping to keep the mortgages in both names for 2 years and then I'm planning to sell the one I'm in so I can downsize.

Has anyone done this and were you able to put in a legal order to say the proceeds of each house will belong to the person living in the house for the 2 years?

Houses currently on market but not selling and if we can take the 2 years to do some work, would probably sell then.

Two years is because of the fixed mortgage deals.

I have a joint mortgage with my exh so i could purchase a property as a family home. My exh signed a declaration of trust stating that he had a 0% claim on the property.

What happens if tiuvwere to default ? He’d be expected to pick up the full liability ? Is he ok with that?

Both of you can and will be chased for defaults.

Banks don't care about divorce.

I suggest looking at who paid what
