ex refuses to sign TR1

Hi,

Need help/advice please.

I recently divorced. Had a joint mortgage with my ex. I've made a consent order which I agreed to pay ex a lump sum and he will transfer the property to me. I continue to live there with my 10 year old son. I would like to remove his name from the mortgage but he refused. I've paid him the lump sum. There's nothing on the consent order to say I'm not allowed to remove his name on the mortgage & house deed. Ex also said he doesn't want anymore money so I don't know what's the issue?

Where do I stand on this? Can I say ex refuse to comply with the consent order? If yes, how do I make application to the court to make him sign the document? What form do I need?

I also can't afford a solicitor or pay the court fees. Is there any way I can get help with these? I heard you can make your ex pay for it?

Anybody had similar experience?

The lump sum should have been paid via a solicitor when he signed the paperwork to be removed. If the consent order was approved by a judge you need to take him back to court - hes broken the consent order which is serious, he would have to pay all your costs. It's worth having a free 30min chat with a local solicitor many offer this service.
