Property adjustment orders

We are looking to get a property adjustment order after our decree nisi comes through. We agree on everything and it all looked straight forward, but the mortgage advisor has said my ex would have to be taken off the deeds of the house before they could transfer the mortgage into my name only.

This doesn't sound correct! I am able easily to manage the mortgage, and the proportion the mortgage company would 'own' is small and wouldn't be affected by the proportion my ex would 'own'.

Does anyone have any experience of these property adjustment orders, information about them seems sparce!!

What is it that you want the order to do? Is it to specify that your ex gets a share of the property at some point in the future, hence him staying on the deeds?

Ultimately, the mortgave adviser is correct that a lender will not want your ex on the deeds but not the mortgage. That's because it would prevent them taking possession of the property if you default on the mortgage, because one of the legal owners is not a party to the loan.

You should probably get legal advice as to the right way to legally structure the financial arrangements.
