Financial settlement in divorce

EllaD26 · 30/04/2019 14:53

Married in Sept 2016
Separated in Sept 2018
Started divorce proceeding in Jan 2019
Intend to apply for financial settlement in Nov 2019

My solicitor told me that both parties will need to disclose the last 12 months of their investments & savings. Per the timeline above, which 12 months will be taken into consideration when deciding on the financial settlement?

Thanks in advance.

I would have thought for a short marriage, you take out what you came in with.

If not, ask your solicitor what time period he wants. Gut reaction is the 12 months prior to separation, but make sure your ExDP provides the same time period.

It's usually the 12 months immediately preceding the date of gathering the disclosure.

If you didn't live together long before marriage, it might be worth suggesting you also get some bank statements to show what you both had at the start of the relationship and then at separation.

It will be the most recent 12 months

Thanks for your reply.
How certain are you of this?

Hi,
What do you mean by "date of gathering the disclosure"?

Thanks for mentioning about bank statements pre marriage cause we didn't live together prior to our marriage & he brought with him no assets & savings of £20 & JOBLESS!!

I went through mediation, then completion of a form E then solicitor led mediation. On each occasion, as they are months apart, i had to update my bank statements, cc statements, wage slips etc so that i had the 12 months immediately preceding. Hope that makes sense.

I see. Thank you very much. You've been very helpful.

I've just submit my forms to the court for a financial remedy and they asked for 12 months bank statements from the date I filled the form in, so from April 18 - April 19. I'm doing that part without my solicitor due to costs but she's on hand for advice if I need it.
