Hi there, can any one advise after being on a horrendous journey the end is nigh . Do you need any witness statements for signing The Consent Order or is it just yourself and your ex ? Thank you

You both need a form A and also a D81 & court fee of £50. Consent orders don’t need to be witnessed but have to be formatted in a certain way.

My consent order was refused by the judge .

We have to do a form D81 apparently as not sent one the first time . I wondered if that is done by us both or just one ?

By not doing this there is now a delay and then a mention hearing in June , Do we both have to attend this ?

Yes you do.

And yes, you both need to complete D81.

@MrsBertBibby do we both have to attend the mention hearing also or do we not have to attend ?

Thank you

Thank you for the replies.

Do you need supporting evidence / proof of income or mortgage with form D81?

My stbx has advised we both fill in the form send to each other and then the hard copy (just one ) is filed to court for the judge ? Is this correct ? He is also writing to say there is no need for the Mention hearing which is only 5 minutes long is this true again?

Maybe have all the info to hand also as judge asked us all sorts of mortgage and outgoing questions

wakeupsmelltheroses · 09/05/2019 16:31

Thank you @gemmajfk I think my ex thinks this is enough information to get the Consent Order signed off thus avoiding court in any way , shape or form at all .

We got called to see the judge, just us 2 and he chatted through the order to make sure we where both happy before signing it off x

Very interesting @gemmajfk I will see what the Judge decides after viewing our D81 but I for one are very pleased the Judge didn't stamp and run but took the time to look at the paperwork and request further information !
