Decree Nisi

*Received letter from court to apply for Decree Nisi.
*I want to place on hold due to other commitments that's taken priority!

Q, Is there a deadline by which I have to apply for Decree Nisi?
Q, Does that give him the right to do anything regarding the divorce? I.e. file another application for divorce, etc?

Thanks,

He can phone up the court find you haven't done anything, put in his own petition and ask a judge to throw yours out. In addition depending in how you have acted he can ask the judge to award costs against you.

Also if you do sod all for a year, you may have to start the initial petition again from scratch.

So crack on with it.

How long are you planning on leaving it for? Many of the courts have delays at the moment, some people are waiting for their decree nisi for 2 months if not more after applying.

I would get proper legal advice OP as there may also be implications for finances in delaying. The whole process can drag on for years though which isn't a problem if you're in agreement.

tworoundabouts is incorrect as lodged petitions don't 'expire'.
