I was under impression that if there is Domestic Abuse involved, I can get Legal Aid. I spoke to CLA and they advised that there is an equity cap at 108k+ Where Legal Aid does not apply.

Has anyone been in this situation? Thanks!

The £108k is made up of up to £100k in asset equity, and £8k of annual disposable income. Does this apply to your circumstances?

I think it does..
I am a high tax earner but my disposable income is wiped out to debt situation in reality each month when DH does not contribute- I end up to pay for all daily living expenses. There is 100k equity in property but not on latest valuation.

okay I have legal aid, because of DV,

they didn't ask me about the equity, but they did ask me to prove about the DV, which I was able to. The process is slow and painful, but it allows you to get the person out of your life. The figures they use is what you have as income, they don't unfortunately look at what debt you have to pay that's not their fault you have debt, so they take off a standard amount for you and your kids and you and then the rest they see as disposable income.

Legal aid of course has to be paid back, and that where they look at your equity as it a good thing it show you can pay back the legal aid when your property is sold, there is a legal aid calculator online look it up it great if you cant find it let me know I can search for it
