CMS (child maintenance) claim when 50:50 custody

Hoping someone can help

If custody is split 50:50 between two parents, can one parent claim via the child maintenance service?

Does parents income get factored into a decision of accepting a claim? I know it's a % of salary but I mean decision to actually pay it, rather than the calculation per se

I am so sorry Ella..please write to your MP and Minister for CMS, Justin Tomlinson.

I am not sure it will immediately help but these situations have to be flagged as children are suffering. Courts seem to assume it's fine for the benefits system to support children (just to live just above the poverty line ) whilst Dads lifestyle is unchanged.
Ex sees his dc only EOW but still only pays 3% of income due to his high earnings whereas 100% of my much lower income goes towards DC.

Something amiss here. Even an NRP on Job Seekers allowance of 73 pounds per week would pay more than that.

Is you Ex self employed, working through a Limited Company or working outside UK so that they can hide what they actually earn? Do you have evidence of his high earnings? If so then you need to push CMS to make a further assessment.
