Ok so I myself have been divorced but my ex husband paid for it and filed.

My partner wants to divorce his ex wife they have been seperated nearly 3 years. How do we go about this. She had an affair but is now denying it. Can we make her pay for it if we apply? And if we apply and she refuses to pay then do we have to our can we stop the process until she does or we have the money? I am just sick of him being associated with it!

I cant think why, I would think the divorce itself would be paid for the one who files, she might even refuse to sign, then he would have to wait for the 5 years to do it that way. Its only if you go through the courts with 3rd parties dealing, that she would have to pay her S for that.

@WeeWheels72 when i got divorced my ex husband filed for it. And there is a box to tick that he pays or he expects me to pay. He ticked he would pay so never worried. My thinking is if he ticks her to pay and she refuses then what happens.

One party will have to pay or perhaps communicate and see if arrangements can be made, to both share the cost?

I honestly doubt she will be willing to pay, to be honest. The only way to get it done will be your OH paying for it. If she really wanted it she would do it, but that doesn't sound the case.

Why should she pay for something you want that doesn’t worry her? Suck it up and pay for it if he wants the divorce

On the newer forms there are 3 boxes, I pay, you pay, or we share. This form was introduced just as my solicitor was submitting my form in September 2017, so he called my ex's solicitor and said we'd go halves. If you are submitting now, why not tick go halves?

No specific requirements as to who pays the Court Fee for the Divorce Application. I know some who have divorced each other just to get their own version of whose fault it was put into writing. Court fee had to be paid twice!!
